I think i have bought a stolen Blackberry?

I bought the phone from Ebay, it said 100% genuine brand new never been used unwanted present. The phone was calling and texting fine up until today it wont let me call or text it just says call failed and retries exceeded, so i have contacted the seller but they don't answer or get back to me? any advice please
